Mandatory Documents

It is mandatory to you gather all the documents proofing the births, marriages, and deaths of your ancestors, from then until your generation. Bear in mind that this Italian relative cannot be naturalized as a Brazilian citizen.

Get the message: Imagine your closest Italian relative (the one who left Italy to live in Brazil) is your great-great-grandfather. The documents needed to proof your right to the Italian citizenship are:

Great-great-grandfather Certificate of Birth (in Italian); Negative Certificate of Naturalization; Marriage Certificate; Death Certificate;

Great-grandfather Certificate of Birth, Certificate of Marriage (if married); Certificate of Death (if deceased);

Grandfather Certificate of Birth, Certificate of Marriage (if married); Certificate of Death (if deceased);

Mother or Father Certificate of Birth, Certificate of Marriage (if married); Certificate of Death (if deceased);

Applicant Certificate of Birth, Certificate of Marriage (if married).

Important

* In Brazil, Notary’s Office has a service called “remarks,” where they include, on only one Certificate all the birth, marriage, divorce and death information. Such “remarks” are not valid in Italy. Therefore, it is mandatory you have all the Certificates individually.

* All the certificates shall be of whole content, with the signature of the Notary acknowledged.

* All the document shall be an original. You can request them at any time at the Notary’s Office it was issued.


Notarization of the documents

Notarize means attest, certify, the materiality of a signature, act; authenticate. As Brazil is now part of the Hague Convention, the notarization of your documents requires the sworn translation and the Apostille. The Citizenship acknowledgement process

Through Administrative Act. When the applicant must go to Italy to ask for the acknowledgement. On this act, Gobbi takes care of the lodging. In few days, the client comes to his country of origin, and Gobbi finished the process by power of attorney. The acknowledgement process is slow. It can take up a few months. Such period lies on many factors: the documents analysis, the way you arrive in Italy, the period to attest residence, the time frame of response from the Italian Consulate to Brazil, and a few more obstacles that may appear; for example, vacation period in Italy, municipal elections among others.

Through Legal Proceeding. Through this act, the client does not have to go to Italy (and spend on trips, lodging, transportation and the like) and can track and trace the whole process through the Internet, because the citizenship is granted by the Court of Rome. 

Does the spouse have right to the citizenship?


If the spouse has Italian ancestors/parents they are entitled to the citizenship. However, if the individual is already an Italian citizen, he/she is entitled to a visa granting them all the rights of working and living in any country within the EU.

This process is time-consuming and can take up to two years and a half to complete. The promptness for obtaining the spouse’s citizenship depends on marriage factors: time of marriage or if it bears children. The longer you are married, and if you have children, the faster the process.

In marriages before 1983, the Italian man grants the citizenship to the woman automatically. It can be done at Gobbi. But the opposite does not happen; the woman does not grant the citizenship to the man automatically.

If the applicant does not reside in Italy, they can only request the citizenship of their spouse after 3 years living in the same country. This can be done at the Italian Consulate in the region they’re living.

Italian citizenship through maternity

In all cases, where the right to Italian citizenship comes from a woman born before 1948 and whose children were also born before 1948, it is necessary to start a legal proceeding.
